Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Ensure Corporation Co., Ltd. ("ESPEK," "we," "us," or "our"). They govern your access to and use of espekusa.com (the "Site"), including product information, inquiry forms, the installer locator, and warranty registration and lookup (together, the "Services").

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms, and "you" includes that business.

2. Use of the Services

You may use the Services to learn about ESPEK products, contact us, find an authorized installer, and register or check a product warranty. Information you submit through the Services must be accurate and complete. We may suspend or restrict access to the Services if you violate these Terms.

3. Installer Access

Authorized ESPEK installers receive an installer code and PIN to register warranties on behalf of their customers. Installer codes and PINs are for the authorized installer's own use only and must be kept confidential. The installer is responsible for all registrations made with its code, for obtaining any notice or consent required by law from its customers before submitting their information, and for the accuracy of what it submits. We may suspend or revoke an installer code at any time. Any separate written dealer, distributor, or installer agreement between you and ESPEK will control if it conflicts with these Terms.

4. Product Information

We try to describe products and their performance accurately. Technical values are measured under the test methods stated in our technical data sheets and may differ in real-world conditions. Colors and appearance may vary depending on your screen, lighting, and vehicle surface. Product availability, specifications, and pricing are set by ESPEK and its authorized installers and distributors and may change without notice.

5. Product Warranty

ESPEK products are covered only by the written limited warranty that applies to each product, available on our warranty page (the "Product Warranty"). Coverage requires installation by an authorized ESPEK installer and registration of the installation. The Product Warranty applies only to the original owner of the vehicle at the time of installation and is not transferable. The Product Warranty is the only warranty we give for our products, and it controls over anything in these Terms that conflicts with it.

6. Product Use and Installation

• Professional installation. ESPEK films are intended to be installed by trained, authorized installers. Improper installation, removal, or surface preparation may damage vehicle paint, glass, or trim and may void the Product Warranty.
• Window tint laws. Laws on window tint darkness (visible light transmission), reflectivity, and windshield coverage differ by state and country. You are solely responsible for confirming that any window film installed on your vehicle complies with the laws where the vehicle is registered and driven.
• Chemical products. Read and follow all label directions and Safety Data Sheets for installation solutions and car care products. Keep them out of reach of children.
• Independent installers. Installers and distributors listed on the Site are independent businesses, not employees or agents of ESPEK. They set their own prices and are responsible for their own workmanship and conduct.

7. Intellectual Property

The Services and all content on them, including text, graphics, logos, product images, videos, and technical documents, are owned by ESPEK or our licensors and are protected by trademark, copyright, and other laws. "ESPEK" and related logos are trademarks of Ensure Corporation Co., Ltd. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our prior written permission. Authorized installers and distributors may use our marks and marketing materials only as permitted in their agreement with us and our brand guidelines.

8. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms;
• Submit false warranty registrations or claims, or register products that are not genuine ESPEK products;
• Use another installer's code or PIN, or share your own with anyone else;
• Sell counterfeit products, or misrepresent yourself as an authorized ESPEK installer or distributor;
• Scrape, crawl, or harvest data from the Services, or use bots without our permission;
• Interfere with or disrupt the Services, or attempt to gain unauthorized access to any system;
• Upload viruses or other malicious code.

9. Third-Party Links and Services

The Services may link to third-party websites and services, such as social media and installer websites. We do not control them and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

10. Disclaimers

Except as expressly provided in the applicable Product Warranty, the Services and all content are provided "as is" and "as available." To the fullest extent permitted by law, ESPEK disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, ESPEK and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Services or these Terms, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed one hundred U.S. dollars (US$100). Claims relating to ESPEK products are governed by the Product Warranty.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless ESPEK and its affiliates, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, any information you submit through the Services, your installation or resale of products (if you are an installer or distributor), or your violation of any law or third-party right.

13. Dispute Resolution

Before filing any claim, you agree to first contact us at email@ensurekr.com and try to resolve the dispute informally for at least 60 days. Business relationships with authorized installers and distributors are governed by the dispute resolution terms of their separate written agreements with ESPEK.

14. General Terms

• Changes. We may update these Terms from time to time. Changes take effect when posted, and the "Last updated" date will be revised. Your continued use of the Services after changes are posted means you accept the updated Terms.
• Termination. We may suspend or end your access to the Services at any time if you violate these Terms. Sections that by their nature should survive termination will survive.
• Export and sanctions. You may not use or export products or the Services in violation of applicable export control or sanctions laws.
• Entire agreement. These Terms, the Privacy Policy, the Product Warranty, and any separate written agreement with us form the entire agreement between you and ESPEK regarding the Services.
• Severability and waiver. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Language. These Terms are written in English. Any translation is provided for convenience only, and the English version controls.
